1. The agreement
These Terms of Service ("Terms") are an agreement between you and the developer of Questify ("Questify", "we", "us"). They cover the Questify mobile app (the "App"), our backend service and this website (together, the "Service"). By creating an account or using the Service, you accept these Terms and acknowledge our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use Questify
You must be at least 13 years old, or older if your country requires a higher age to use online services without a parent's consent (for example, up to 16 in parts of the EEA). If you're under 18, you confirm that a parent or guardian has reviewed these Terms with you.
3. Your account
- You can start as a guest, or sign in with Apple or Google. Guest data is tied to that install — link a sign-in method in Settings to keep it if you change or reset your phone.
- You're responsible for activity on your account and for keeping your device and sign-in secure.
- Tell us promptly at evil.monkey.corporation@gmail.com if you think someone else has accessed your account.
4. Your content
You own everything you create in Questify — quests, vows, rewards, notes and feedback ("Your Content"). You give us a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy and display Your Content solely to operate and improve the Service for you. This licence ends when you delete the content or your account, except for residual copies in backups that expire on their normal schedule (see the Privacy Policy).
If you send us feedback or ideas, we may use them to improve Questify without any obligation to you.
5. Emeralds and rewards
- Emeralds are virtual points that track your progress inside the App. They have no monetary value, are not currency or property, can't be bought, sold, transferred or exchanged for money or anything else, and can't be redeemed with us or anyone else.
- Rewards are self-defined. A "reward" is a note you create to treat yourself when you spend emeralds. Questify does not provide, fund, deliver or guarantee any reward.
- We may rebalance how emeralds are earned (for example, amounts per difficulty) to keep the game fair and fun. Emeralds are lost if you delete your account.
6. Acceptable use
You agree not to:
- break the law or infringe anyone's rights using the Service;
- probe, scan, overload or attack the Service, bypass its security or rate limits, or access it with automated tools other than the App;
- reverse-engineer the App except where the law expressly allows it;
- impersonate others, or use the Service to send spam or harmful, hateful or illegal content;
- resell or commercially exploit the Service without our written permission.
7. Not professional advice
Questify is a motivation tool. It is not medical, psychological, fitness, nutritional or financial advice. Check with a qualified professional before making significant changes to your health or exercise routine, and listen to your body — no streak is worth an injury.
8. Paid features
The core Service is free. If we offer optional paid features in the future, they will be sold through the Apple App Store or Google Play, under their payment and refund terms. We'll show the price and what's included before you buy, and any subscription can be managed or cancelled in your store account settings.
9. Our app and licence
The App, its design, artwork, name and logo belong to us or our licensors. We give you a personal, revocable, non-exclusive, non-transferable licence to install and use the App on devices you own or control, for your own non-commercial use, in line with these Terms and the app store's usage rules. Third-party open-source components are licensed under their own terms.
10. Changes and availability
We're constantly improving Questify, so features may change, be added or be removed. We aim to keep the Service available, but it may occasionally be interrupted for maintenance or reasons outside our control. If we ever shut the Service down, we'll give you reasonable notice and a way to export your data.
11. Ending the agreement
You can stop using the Service and delete your account anytime (Settings → Delete Account, or on the web). We may suspend or close accounts that seriously or repeatedly break these Terms, or where required by law — we'll tell you why unless we're legally unable to. Sections that by their nature should survive (such as ownership, disclaimers and limitation of liability) survive termination.
12. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that data will never be lost — export your data if it matters to you.
13. Limitation of liability
To the extent permitted by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
Nothing in these Terms limits liability that can't be limited by law — for example, for death or personal injury caused by negligence, or for fraud — or takes away the rights you have as a consumer under the mandatory laws of your country.
14. Apple and Google
If you downloaded the App from the Apple App Store, you and we also agree that:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- If a third party claims the App infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm you're not located in a country subject to a US Government embargo or designated as "terrorist supporting", and you're not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded the App from Google Play, Google's Play Terms of Service also apply to your use of the store. If anything in the store's terms conflicts with these Terms regarding the store itself, the store's terms win.
15. Governing law and disputes
Let's try to sort things out informally first — email evil.monkey.corporation@gmail.com and we'll do our best to help within 30 days. These Terms are governed by the laws of the country in which the developer of Questify is established, without regard to conflict-of-law rules. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts. EU consumers can also use the EU's consumer redress resources.
16. Changes to these terms
We may update these Terms as the Service evolves. We'll change the date at the top, and for material changes we'll notify you in the App at least 14 days before they take effect. If you keep using the Service after that, the new Terms apply; if you don't agree, you can delete your account.
